Mpalo Terms of Use

Effective Date: March 28, 2025

PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING THE MPALO SERVICES. YOUR ACCESS TO AND USE OF THE SERVICES IS CONDITIONED ON YOUR ACCEPTANCE OF AND COMPLIANCE WITH THESE TERMS.

1. Introduction and Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of the services provided by Mpalo GmbH ("Mpalo," "we," "us," or "our"), including our website, APIs, software, tools, and related documentation (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

Our Privacy Policy, Trust & Ethics policy, and other documentation, guidelines, or policies we may provide are incorporated by reference into these Terms. Please read them carefully.

2. Definitions

  • "Service" means the Mpalo website, APIs, Browser Extension, software, AI Models, and related functionalities provided by Mpalo, including AI Memory, Personalization, and Multi-modal Data handling.
  • "User" means any individual or entity accessing or using the Service.
  • "AI Memory" refers to the Service's capability to retain, recall, and utilize information from past interactions with a User to inform future interactions, encompassing both episodic (specific events and context) and semantic (general knowledge) memory aspects. This feature aims to provide a more continuous, humanlike, and context-aware experience.
  • "Personalization Data" means data provided by or generated about a User (such as interaction history or preferences) that is processed by the Service specifically to tailor the AI's responses, behavior, and the overall user experience to that individual User, including enabling AI Memory features.
  • "Multi-modal Data" refers to the various forms of data input that the Service can process (e.g., text, images, audio) and the forms of output it can generate.
  • "User Content" means any data, text, images, prompts, audio, or other materials inputted into, uploaded to, or generated by the User through their interaction with the Service, including via the Browser Extension.
  • "AI Output" means content, responses, or information generated by the Service's AI based on User Content or other inputs.
  • "Browser Extension" means the Mpalo software installable in a web browser designed to interact with third-party services (like chatbots) by leveraging Mpalo's AI Models.
  • "AI Models" refers to Mpalo's proprietary artificial intelligence models, including different versions or tiers (e.g., Lite, Palo Bloom, DEEP, DEEP-Research), that provide the core AI functionalities of the Service.
  • "Third-Party Services" refers to websites, applications, chatbots, or other services not owned or controlled by Mpalo, with which the Browser Extension or other parts of the Service may interact.
  • "Classified Technology" refers to Mpalo's core underlying AI architecture and specific technical details considered proprietary and confidential, primarily for competitive reasons.

3. Description of Services

Mpalo provides an evolving platform featuring proprietary artificial intelligence components designed to incorporate memory (AI Memory), offer tailored experiences (using Personalization Data), and process diverse data types (Multi-modal Data). The Service components may include, but are not limited to:

3.1. Browser Extension

Mpalo offers a Browser Extension designed to enhance user interactions with certain existing Third-Party Services, primarily third-party chatbots detected on websites. The typical workflow involves the extension detecting a compatible chatbot interface, allowing the User to optionally utilize Mpalo's AI Models to process or augment their input before it is sent to the Third-Party Service, or to process the output from the Third-Party Service. The purpose is to leverage Mpalo's unique AI Memory and processing capabilities within the context of other platforms.

Interaction with Third-Party Services: The Browser Extension interacts with Third-Party Services. Your use of those Third-Party Services is governed solely by their respective terms of service and privacy policies. Mpalo is not responsible for the functionality, content, accuracy, legality, or privacy practices of any Third-Party Service. Data you submit to Third-Party Services, even via our Browser Extension, is subject to their policies.

3.2. Modular AI Models (Lite, Palo Bloom, DEEP, DEEP-Research)

The core of the Service involves Mpalo's proprietary, modular, transparent, and humanlike AI Models, with a key focus on providing "episodic memory" capabilities. These models are designed for integration into various applications, including the Browser Extension, chatbots, robotics, and other software via our APIs. Different tiers or versions of these models (e.g., Lite, Palo Bloom, DEEP, DEEP-Research) may be available, offering varying capabilities related to processing speed, memory retention depth, contextual understanding, and other features. For example, 'Lite' might offer basic memory enhancement, while 'DEEP' provides more complex contextual understanding and longer memory spans.

3.3. APIs and Workbench

Mpalo may provide APIs allowing developers to integrate Mpalo's AI functionalities into their own applications. A user workbench or similar interface may also be provided for direct interaction, testing, and management of the Service.

3.4. Classified Technology

Mpalo's core underlying AI architecture and specific technical details are considered proprietary and confidential ("Classified Technology"), primarily for competitive reasons, potentially temporarily while establishing its market presence. Our descriptions focus on the functionality, applications, and benefits provided to the User, rather than revealing sensitive technical implementation details.

3.5. Modifications and Evolution of Service

We reserve the right to modify, suspend, or discontinue the Service, or any part or feature thereof (including the Browser Extension, specific AI Models, APIs, or features like AI Memory), at any time in our sole discretion, with or without notice. Due to the rapidly evolving nature of AI, we also reserve the right to update, change, or replace the underlying AI Models, algorithms, and features. You acknowledge that the capabilities, performance, availability, and outputs of the AI may change over time.

Usage limitations, such as API call quotas, data storage limits, Browser Extension feature restrictions, or model access tiers, may apply based on your subscription plan or usage patterns, as detailed on our pricing page or within the Service interface.

4. User Responsibilities and Obligations (Acceptable Use)

You agree to use the Service only for lawful purposes and in accordance with these Terms. You are responsible for your conduct and your User Content while using the Service.

4.1. Prohibited Activities

You agree not to use the Service, including the Browser Extension, to:

  • Engage in any activity that is illegal under applicable local, state, national, or international law.
  • Upload, transmit, or generate any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, hateful, discriminatory, invasive of another's privacy, or otherwise objectionable.
  • Generate or disseminate misinformation, disinformation, or spam.
  • Infringe upon or violate the intellectual property rights of Mpalo or any third party.
  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, the server on which the Service is stored, or any server, computer, or database connected to the Service.
  • Transmit any viruses, worms, defects, Trojan horses, or any items of a destructive nature.
  • Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code, underlying algorithms, or architecture of the AI Models or other aspects of the Service, except to the extent such activity is expressly permitted by applicable law notwithstanding this limitation.
  • Use the AI to create content that promotes illegal acts or is intended to harass, harm, or endanger individuals or groups.
  • Misrepresent AI Output as solely human-generated content with the intent to deceive.
  • Exceed usage limits or circumvent any technical limitations imposed on the Service.
  • Use the Service to develop competing products or services.
  • Scrape, data mine, or extract data from the Service in an unauthorized manner.

4.2. Browser Extension Usage

  • You are solely responsible for ensuring that your use of the Browser Extension complies with the terms of service, usage policies, and community guidelines of any Third-Party Service you interact with using the Extension.
  • You agree not to use the Browser Extension in any manner that violates the terms of service of such Third-Party Services.
  • You agree not to use the Browser Extension to attempt to circumvent rate limits, access controls, content filters, or other restrictions imposed by Third-Party Services.
  • You understand that the Browser Extension is a tool to augment your interaction with Third-Party Services and that Mpalo is not responsible for the actions or content of these Third-Party Services.

4.3. Interactions with Third-Party Services

  • As stated previously, Mpalo is not responsible for the content, accuracy, legality, availability, security, or privacy practices of any Third-Party Services accessed or interacted with, whether via the Browser Extension or otherwise.
  • We strongly advise you to review the terms of service and privacy policies of any Third-Party Service before engaging with it or submitting any data to it.
  • Any complaints, issues, or disputes arising from your interactions with Third-Party Services should be directed solely to the relevant third party.

4.4. Account Security

You are responsible for safeguarding your account credentials (username and password) and for any activities or actions that occur under your account. You agree to notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4.3 License to Mpalo for User Content

To enable the functionality of the Service, you grant Mpalo a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, prepare derivative works of, display, and perform your User Content (and AI Output derived from it) solely for the limited purposes of: (a) operating, providing, maintaining, securing, and improving the Service specifically for you (including enabling AI Memory and Personalization features tailored to your use); (b) conducting internal research and analysis focused strictly on Service performance, reliability, and improvement (provided that such research uses aggregated and anonymized data to the extent technically feasible); and (c) complying with applicable legal obligations and enforcing these Terms.

4.4 AI Output

The Service may generate output based on your User Content ("AI Output"). While you may use the AI Output for any lawful purpose, you acknowledge that it is generated by an AI system and may not be unique, accurate, or complete. You must not represent AI Output as being generated by a human or use it in a way that infringes third-party rights, or contravene applicable laws. You are solely responsible for the creation, use, and consequences of the AI Output, including ensuring its legality, accuracy, and appropriateness for your intended application. Mpalo makes no claims regarding the copyrightability or ownership of AI Output, and you should consult with legal counsel to determine its status.

5. Intellectual Property Rights

Mpalo's Rights: The Service and its original content (excluding User Content and AI Output derived directly from unique User Content prompts, subject to the license below), features, functionality, and underlying technology, including but not limited to all software, algorithms, AI Models, databases, text, graphics, logos, and trademarks, are and will remain the exclusive property of Mpalo and its licensors. The Service is protected by copyright, trademark, patent, trade secret, and other laws of both Germany and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Mpalo.

No Use of User Data for General AI Training: Mpalo explicitly commits that it does not use your User Content or Personalization Data for the training or improvement of its general artificial intelligence models offered to other users or the public. Your data is used solely to provide and enhance the Service *for you*, as detailed below and in our Privacy Policy.

User Content License Grant: You retain any ownership rights you may have in the User Content you submit or input into the Service. However, by submitting User Content, you grant Mpalo a worldwide, non-exclusive, royalty-free, perpetual, irrevocable (subject to termination rights and data deletion policies), sublicensable, and transferable license to use, reproduce, modify, adapt, anonymize, aggregate, store, process, distribute, perform, and display such User Content (and AI Output derived from it) **solely** for the limited purposes of: (a) operating, providing, maintaining, securing, and improving the Service **specifically for you** (including enabling AI Memory and Personalization features tailored to your use); (b) conducting internal research and analysis focused strictly on Service performance, reliability, and improvement, prioritizing anonymization and aggregation techniques where possible; (c) enforcing these Terms and preventing prohibited activities; and (d) complying with applicable law and legal processes. This license does not grant us the right to sell your User Content or use it for general model training unrelated to your specific service provision.

AI Output: Subject to your compliance with these Terms and applicable law, and acknowledging the evolving legal landscape regarding AI-generated works, Mpalo grants you a worldwide, non-exclusive, royalty-free license to use the AI Output generated specifically for you through your use of the Service for your own purposes, including commercial purposes, provided such use does not violate these Terms, infringe third-party rights, or contravene applicable laws. **You are solely responsible for the creation, use, and consequences of the AI Output**, including ensuring its legality, accuracy, and appropriateness for your intended application. Mpalo makes no claims regarding the copyrightability or ownership of AI Output, and you should consult legal counsel regarding your rights and obligations related to AI Output.

User Warranty: You represent and warrant that you have all necessary rights, licenses, consents, and permissions to submit your User Content and that your User Content (and your use of AI Output) does not and will not infringe upon or violate the intellectual property rights, privacy rights, publicity rights, or any other rights of any third party, nor violate any applicable laws.

Feedback: Any feedback, comments, or suggestions you may provide regarding Mpalo or the Service ("Feedback") is entirely voluntary. You grant Mpalo a worldwide, perpetual, irrevocable, royalty-free license to use, modify, incorporate, and otherwise exploit such Feedback for any purpose, including improving the Service and developing new products, without any obligation or compensation to you.

6. Privacy Policy

Your privacy and the security of your data are critically important to us. Our collection, use, storage, processing, and disclosure of your personal data, **including the specific handling of 'Personalization Data' essential for features like AI Memory and personalization**, are governed by our comprehensive Privacy Policy. This policy is accessible on our website and is incorporated into these Terms by reference.

**It is essential that you review the Privacy Policy carefully.** It provides crucial details on:

  • The specific types of personal data we collect (including User Content and Personalization Data).
  • The purposes for which we process your data (including enabling core functionality, AI Memory, Personalization, Browser Extension operation, security, and improvement).
  • The **lawful basis** under GDPR (and other applicable laws) for each processing activity (e.g., necessity for contract performance, your explicit consent where required, legitimate interests).
  • How we handle data specifically used for AI features like memory and personalization, including consent mechanisms if applicable.
  • Our data **retention** periods.
  • The technical and organizational **security** measures we implement.
  • Information on any international data **transfers** and the safeguards used.
  • Your **rights** regarding your personal data (such as access, rectification, erasure, restriction, portability, objection, withdrawal of consent, and rights related to automated decision-making).
  • How to **exercise** your rights and contact us or data protection authorities.

7. Disclaimers and Limitations of Liability

General Disclaimer of Warranties: THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS. TO THE FULLEST EXTENT PERMITTED BY LAW, MPALO AND ITS AFFILIATES, LICENSORS, AND SUPPLIERS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, AND NON-INFRINGEMENT. MPALO MAKES NO WARRANTY THAT THE SERVICE, INCLUDING THE AI FEATURES (MEMORY, PERSONALIZATION, MULTI-MODAL PROCESSING) AND THE BROWSER EXTENSION, WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, ACCURATE, COMPLETE, OR RELIABLE, OR THAT ANY DEFECTS WILL BE CORRECTED.

AI-Specific Disclaimers:

  • Evolving Nature: YOU ACKNOWLEDGE THAT ARTIFICIAL INTELLIGENCE IS A RAPIDLY EVOLVING FIELD. THE AI MODELS USED BY THE SERVICE MAY PRODUCE OUTPUT (AI OUTPUT) THAT IS UNEXPECTED, INACCURATE, INCOMPLETE, BIASED, OFFENSIVE, OR OTHERWISE UNDESIRABLE. PERFORMANCE AND CAPABILITIES MAY CHANGE OVER TIME.
  • Accuracy and Reliability: AI OUTPUT IS GENERATED ALGORITHMICALLY AND MAY CONTAIN FACTUAL ERRORS, OMISSIONS, OR REFLECT BIASES PRESENT IN THE TRAINING DATA OR ALGORITHMS. IT MAY NOT BE UP-TO-DATE. MPALO DOES NOT GUARANTEE THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF ANY AI OUTPUT.
  • Classified Technology: You acknowledge that the specific technical details of Mpalo's AI technology ("Classified Technology") are proprietary and not fully disclosed. Our descriptions focus on functionality and user benefits.

Browser Extension Compatibility Disclaimer: MPALO DOES NOT WARRANT THAT THE BROWSER EXTENSION WILL BE COMPATIBLE WITH ALL THIRD-PARTY SERVICES, WEBSITES, OR BROWSERS, OR THAT IT WILL FUNCTION WITHOUT INTERRUPTION OR ERROR WHEN INTERACTING WITH THIRD-PARTY SERVICES. YOUR USE OF THE BROWSER EXTENSION WITH THIRD-PARTY SERVICES IS AT YOUR OWN RISK.

CRITICAL RELIANCE DISCLAIMER: THE SERVICE AND ANY AI OUTPUT ARE PROVIDED FOR INFORMATIONAL AND AUGMENTATION PURPOSES ONLY. THEY ARE NOT INTENDED TO BE A SUBSTITUTE FOR PROFESSIONAL ADVICE, JUDGMENT, OR VERIFICATION. YOU MUST NOT RELY ON THE SERVICE OR AI OUTPUT FOR CRITICAL DECISIONS WHERE ERRORS OR INACCURACIES COULD LEAD TO SIGNIFICANT HARM, LOSS, OR DAMAGE, INCLUDING BUT NOT LIMITED TO MEDICAL, LEGAL, FINANCIAL, SAFETY-RELATED, OR ENGINEERING DECISIONS. Limitation of Liability: TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MPALO, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON OR THROUGH THE SERVICE (INCLUDING THIRD-PARTY SERVICES INTERACTED WITH VIA THE BROWSER EXTENSION); (III) ANY CONTENT OR AI OUTPUT OBTAINED FROM THE SERVICE, INCLUDING ANY RELIANCE PLACED ON SUCH CONTENT OR OUTPUT; (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS, USER CONTENT, OR PERSONALIZATION DATA; OR (V) ANY OTHER MATTER RELATING TO THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE), EVEN IF MPALO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Liability Cap: TO THE FULLEST EXTENT PERMITTED BY LAW, MPALO'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF OR INABILITY TO USE THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT PAID BY YOU TO MPALO FOR ACCESS TO OR USE OF THE SPECIFIC SERVICE COMPONENT GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR (B) ONE HUNDRED EUROS (€100.00).

Exceptions (Mandatory German Law): The foregoing limitations of liability do not apply to liability resulting from Mpalo's gross negligence (grobe Fahrlässigkeit) or willful misconduct (Vorsatz), or for death or personal injury (Verletzung von Leben, Körper, Gesundheit) caused by Mpalo's negligence or willful misconduct. Furthermore, these limitations do not apply to liability arising from the breach of essential contractual obligations (wesentliche Vertragspflichten or Kardinalpflichten), the fulfillment of which is essential for the proper execution of the contract and on whose observance the user regularly relies and may rely. In cases of liability for the breach of such essential contractual obligations due to simple negligence (einfache Fahrlässigkeit), Mpalo's liability shall be limited to the typically foreseeable damage (vertragstypischer, vorhersehbarer Schaden). Liability under the German Product Liability Act (Produkthaftungsgesetz) remains unaffected.

Third-Party AI Disclaimer: If the Service incorporates, links to, or relies on third-party AI models or services (e.g., potentially for specific functionalities), Mpalo disclaims responsibility for the performance, accuracy, reliability, security, or data handling practices of such third-party offerings, which are governed by their own terms and policies.

8. Termination of Service

Termination by Mpalo: We may suspend or terminate your access to all or any part of the Service at any time, with or without cause, with or without notice, effective immediately. Grounds for termination may include, but are not limited to, if we believe, in our sole discretion, that you have violated these Terms, engaged in illegal or fraudulent activity, failed to pay applicable fees, if your use of the Service poses a security risk, infringes on intellectual property rights, or may cause harm to Mpalo, other users, or third parties, or if required by law or due to discontinuation of the Service.

Termination by User: You may terminate your account and cease using the Service at any time by following the instructions within the Service interface (e.g., in account settings) or by contacting us at [EXAMPLE - REPLACE: support@mpalo.com]. If you are subscribed to a paid plan, specific cancellation procedures, notice periods, and potential refund policies may apply as outlined in your subscription agreement or on our website.

German Consumer Cancellation (Subscription Services - § 312k BGB): If you are a consumer residing in Germany and have entered into a paid subscription contract online with us, you have the right to cancel your contract easily. We provide a clearly labelled and easily accessible cancellation button or link on our website, typically labelled "Verträge hier kündigen" (Cancel contracts here) or similar unambiguous wording, in accordance with § 312k BGB (German Civil Code). Activating this button/link will lead you to a confirmation page where you can provide necessary details (if required) and finalize the cancellation with a second, clearly labelled confirmation button (e.g., "Jetzt kündigen" - Cancel now). Confirmation of cancellation will be provided electronically. Failure to provide this compliant mechanism grants you the right to terminate your subscription contract at any time without notice.

Consequences of Termination: Upon termination, your right to access and use the Service will immediately cease. You may lose access to your account and any User Content, Personalization Data, or AI Output associated with it. Mpalo may delete your User Content and account data in accordance with our data retention policies outlined in the Privacy Policy, subject to legal obligations to retain certain information. Sections of these Terms that by their nature should survive termination shall survive, including, without limitation, ownership provisions (Section 5), warranty disclaimers (Section 7), indemnity, limitations of liability (Section 7), governing law and jurisdiction (Section 9), and miscellaneous provisions.

9. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Germany, without giving effect to any choice or conflict of law provision or rule. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded.

Subject to the rights of consumers residing in the EU, you agree that the courts located in [EXAMPLE - REPLACE: Bonn], Germany shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or the Service. If you are a consumer habitually resident in the European Union, you benefit from mandatory provisions of the law of your country of residence, and legal proceedings may be brought either in Germany or in the EU Member State in which you are domiciled.

The European Commission provides an online dispute resolution (ODR) platform, accessible at https://ec.europa.eu/consumers/odr. We are not obligated and generally not willing to participate in dispute resolution proceedings before a consumer arbitration board.

10. Modifications to the Agreement

Mpalo reserves the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material (e.g., affecting your rights or obligations significantly), we will provide reasonable notice prior to the new terms taking effect, such as by posting a prominent notification on our website, sending an email to the address associated with your account, or through an in-service notification. What constitutes a material change will be determined at our sole discretion, but will typically include changes to fees, liability limitations, or significant alterations to the Service.

We will indicate the "Last Updated" date at the top of these Terms. Your continued access to or use of our Service after the effective date of the revised Terms constitutes your acceptance of the revised terms. If you do not agree to the new terms, in whole or in part, you must stop using the website and the Service and terminate your account.

12. Severability Clause

  • Data Governance and Usage: We employ internal policies and technical measures for the governance of data used in connection with our AI systems, including User Content and Personalization Data utilized for AI Memory and personalization features. Our practices prioritize security and privacy, as detailed in our Privacy Policy. **Crucially, as stated in Section 5, we do not use your specific User Content or Personalization Data to train our general AI models shared across users.**
  • Bias and Fairness: AI systems can reflect biases present in the data they were trained on or inherent in their algorithms. While Mpalo strives for fairness and undertakes efforts to identify and mitigate harmful biases in its AI Models, we cannot guarantee that AI Output will be entirely free from bias. You agree not to use the Service in a manner that promotes unlawful discrimination or harm based on protected characteristics. We are committed to ongoing efforts in responsible AI development.
  • Accuracy & Reliability (Reiteration): As emphasized in the disclaimers (Section 7), AI Output may not always be accurate, complete, reliable, or up-to-date. You bear sole responsibility for critically evaluating, verifying, and validating AI Output before any reliance or use, especially for important matters.
  • Human Oversight and Responsibility: While Mpalo employs human oversight in the development, testing, and monitoring of its AI systems, you remain ultimately responsible for your use of the Service, the inputs you provide (User Content), the interpretation and application of the AI Output, and compliance with all applicable laws and ethical standards.
  • Output Ownership and Responsibility: Subject to third-party rights and these Terms, you may own the inputs you provide. As per Section 5, Mpalo grants you a license to use the AI Output generated for you. However, you are solely responsible for ensuring that your input and the subsequent AI Output do not infringe any third-party rights and that your use of the output is lawful and appropriate.
